ASSISTED LIVING ACTIONS FOR ABUSE AND NEGLECT
Assisted living facilities—also called Residential Care Facilities for the Elderly (RCFEs)—are required by California law to provide a safe environment, proper supervision, and assistance with activities of daily living. When facilities ignore medical needs, fail to protect residents from falls or assaults, allow wandering, or hire unqualified staff, these breakdowns often result in serious harm. Although assisted living is a non-medical model of care, California elder-abuse case law still applies when the neglect rises to the level of recklessness or intentional misconduct. In Delaney v. Baker, the court held that disregard for a dependent elder’s known needs can constitute reckless neglect under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA). Sababin v. Superior Court confirmed that ignoring care plans, failing to document required checks, or withholding necessary supervision may support an elder-abuse finding when done with conscious disregard. Mack v. Soung recognized that delaying or withholding needed care or failing to intervene in dangerous situations can rise above negligence. And Covenant Care established that systemic violations of resident-safety rights may justify punitive damages. When assisted living facilities fail to meet licensing standards—resulting in falls, elopement, dehydration, pressure injuries, medication errors, physical abuse, or wrongful death—families may pursue full compensation, including pain and suffering, attorney’s fees, and, in egregious cases, punitive damages. Assisted living facilities are not exempt from accountability; California law requires them to protect vulnerable residents, and courts will hold them responsible when they fail.
