SEXUAL ABUSE AND ASSAULT IN NURSING HOMES
Sexual abuse in nursing homes is one of the most devastating and egregious forms of elder mistreatment. These cases often involve caregivers, staff members, or inadequately supervised residents exploiting vulnerable elders who cannot protect themselves. California courts treat sexual assault of a dependent adult as per se elder abuse, entitling families to enhanced remedies under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA). In Covenant Care v. Superior Court, the California Supreme Court held that violations of resident safety rights and intentional misconduct—including abuse and assault—can support punitive damages when the conduct reflects conscious disregard for resident welfare. Delaney v. Baker confirms that reckless or intentional mistreatment of a dependent elder goes far beyond negligence and qualifies for heightened civil penalties. Courts have repeatedly recognized that facilities may also be liable when they fail to supervise known predators, ignore warning signs, or engage in understaffing that allows sexual abuse to occur unchecked. These incidents often lead to substantial compensation, including pain and suffering, psychological trauma, medical and counseling costs, attorney’s fees, and punitive awards designed to hold both the perpetrator and the facility fully accountable. Sexual abuse is never an accident — it is a catastrophic failure of protection, supervision, and basic human dignity, and California law gives families powerful tools to seek justice.
