INFECTION, SEPSIS, DELAYED TREATMENT IN NURSING HOME ABUSE CASES
Infections—such as untreated UTIs, pneumonia, catheter-related infections, and sepsis—are among the most dangerous consequences of nursing home neglect. Many become life-threatening when staff fail to monitor symptoms, ignore vital signs, or delay transferring a resident to the hospital. California courts treat these failures seriously. Mack v. Soung emphasized that withholding necessary medical care or delaying emergency treatment may support a finding of recklessness. Sababin v. Superior Court held that not following care plans, failing to monitor skin breakdown, and ignoring warning signs can qualify as elder abuse when done with conscious disregard. When a facility’s inaction leads to septic shock or death, families may pursue enhanced EADACPA damages—including attorney’s fees and, in extreme cases, punitive damages under Covenant Care principles. These cases establish that untreated infections are not “unavoidable”—they are often the product of neglect.
