An elder abuse law firm in California that builds every case on the facility's own records, using the enhanced remedies of the Elder Abuse and Dependent Adult Civil Protection Act.
Jasinska Law Firm Professional Corporation represents victims of nursing home abuse, neglect, medical malpractice, and serious injuries across California. The firm's work is guided by one idea: the chart tells the truth if someone who understands it reads it.
California treats neglect of a resident in a care facility differently from an ordinary injury claim. When a facility acts with recklessness, oppression, fraud, or malice, the Act allows the family to recover attorney's fees and costs and damages for the resident's pain and suffering, even if the resident has since passed away (Welfare and Institutions Code section 15657). Neglect under the Act includes failing to provide food, water, hygiene, medical care, or protection from health and safety hazards (section 15610.57).
The facility's defense is almost always the same: the resident was old, frail, and declining anyway. The answer is in the record. Staffing sheets show how many aides were on the floor. Care plans show what the facility knew the resident needed. Nursing notes show whether it was done.
A nurse knows what a complete assessment looks like, what a copied-forward note looks like, and how an electronic record timestamps every entry. That review happens in-house, before any outside expert is retained, so the case is built on what the record proves and weak cases are turned away early.
